The process for transferring firearms in Malta, governed by the Arms Act (Chapter 480) of Malta, and related regulations, is designed to ensure that transfers are conducted responsibly, with both the acquiring and selling parties meeting legal requirements.
Purpose
- Possession of a Valid Firearm License: Individuals must hold a valid license issued by the Commissioner to legally acquire or transfer firearms, ensuring responsible ownership and compliance with firearm regulations.
Application & Eligibility
- Approval Process: The transfer process requires approval by the Weapons Office, following verification of both parties’ licenses and compliance with regulatory requirements.
- Notification & Documentation: Both the acquiring and transferring parties, including heirs inheriting firearms, must complete and submit the necessary documentation to the Weapons Office. This includes details of the firearms to be transferred and the Proforma for the Transfer of a Firearm, a required form for all firearm transfers. This documentation ensures traceability and legality in firearm ownership transfers. ( Download Form )
Requirements & Conditions
- Verification By Weapons Office: The Weapons Office reviews and validates the information provided by both parties to confirm eligibility for the transfer, including verifying licenses and ensuring all firearms comply with the regulations specified in the Arms Act.
- Inspection by Ballistics Unit (if required): Depending on the type and condition of the firearm, an inspection by the Ballistics Unit may be necessary to ensure correct classification and condition before approval.
Additional Information For Heirs
- Transfers by Inheritance: In cases where firearms are transferred through inheritance, heirs must initiate the transfer process within two years. If heirs do not hold a firearm license, they may be required to apply for one based on the firearm’s classification. All firearms transferred by inheritance are subject to the same documentation and, if necessary, inspection by the Ballistics Unit to ensure proper handling under the law. ( Download Form )
